A Saint John judge has reserved decision on an application for a court injunction to stop the upgrade of the Rothesay Common from continuing but has given no indication when his ruling will be announced.
Rothesay resident Jim Crosby is accusing the town of circumventing the democratic process because no public hearings were held on the 2.2 million dollar project. He claims it’s tearing the fabric of the town apart and destroying its character.
The town accuses Crosby of trying to usurp the authority of the Planning Appeal Board which has the authority to stop the work if it wishes.
The town also pointing out there has been an ice surface on the Common for 85 years with the only difference, with the upgrade, being underground pipes so it remains frozen.
The court was also told the upgrade was in the works for 3 years before work began recently and the town argues it adheres to its Municipal Plan with the approval of town council.
