Irving Oil is trying to get two damage claims filed by former company C-E-O Mike Ashar thrown out.
Ashar filed a 50 million dollar lawsuit claiming misconduct by members of the Irving family created an intolerable and poisoned work environment. The company argues Ashar stayed on after his allegations of inappropriate conduct which negates the claim of constructive dismissal.
The company also wants the claim of mental distress dismissed, arguing that’s only valid if something improper happens in the manner of dismissal while Ashar left the company early on mutually agreed to terms.
