In two weeks Canadians will be able to purchase marijuana for recreational use, but the Cannabis Control Act regulates where you can consume it.
Using cannabis in any form is illegal anywhere but in a private dwelling, or adjacent land, like a backyard.
Landlords are allowed to restrict smoking and growing of cannabis, but cannot stop the non-smoking consumption of cannabis. A no smoking clause can be added to an existing lease only by agreement of the tenant and the landlord, while current bans in leases apply to all kinds of smoking. Medical cannabis users must obey no smoking clauses in their leases, but while landlords can restrict smoking, other kinds of consumption are permitted.
Adults over 19 years of age are permitted to carry up to 30 grams of dried cannabis or equivalent in public, and there are no restrictions on the amount kept in a home. New Brunswickers are also allowed to grow up to four plants on their own property.
If grown indoors, they must be in a separate, locked space, while if oudoors, they must be behind a locked enclosure 1.52 metres high.
In New Brunswick, as of October 17th, the only legal place to purchase marijuana will be Cannabis NB stores, or online through their website. Dispensaries will remain illegal, as they are currently.
