After a thorough review, provincial Crown prosecutors will not be appealing the decision to order a second trial for Marissa Shephard.
Shephard was sentenced to life in prison for the murder of 18-year-old Baylee Wylie in December of 2015.
The Court of Appeal ordered a new trial on the basis that trial fairness was compromised.
However, Crown prosecutor Kathryn A. Gregory says they’ve concluded that a sufficiently compelling argument does not exist that the trial fairness issues in this case are of national significance.
Only about 80 of the 600 applications per year for leave to appeal to the Supreme Court are granted.
The Shephard matter will return to the Court of Queen’s Bench in the coming weeks to set new trial dates, while the accused remains in custody pending her second trial.
