The Canadian Civil Liberties Association (CCLA) has filed a notice of motion for public-interest standing in its abortion challenge in New Brunswick.
The national human rights organization is seeking the court’s recognition that it can pursue this challenge on behalf of the public.
“The Canadian Civil Liberties Association has a direct interest, alongside women, girls, and trans individuals, in ensuring that the province obey its obligations under the Charter, the New Brunswick Human Rights Act and the Canada Health Act,” Noa Mendelsohn Aviv, director of equality of program, said in a statement.
Association members announced in January that they were taking the province to court over access to abortion services.
They want the Court of Queen’s Bench to repeal legislation preventing Medicare from covering out-of-hospital abortions.
The association has said it is confident the court challenge will be successful.
