A proposed class-action lawsuit involving the Horizon Health Network and a former Moncton nurse can go ahead.
The Supreme Court of Canada announced Thursday it will not review a lower court ruling that certified the lawsuit.
Nurse Nicole Ruest is accused of giving a labour-inducing drug to women without their permission while she worked at The Moncton Hospital.
New Brunswick’s Court of King’s Bench initially dismissed the class-action lawsuit in late 2023.
But just over a year later, in December 2024, the New Brunswick Court of Appeal ruled it could move forward.
Ruest and Horizon Health were seeking permission from Canada’s top court to appeal that ruling.
